The Web For Business.com Service Agreement, Version 3, 2001


Please read the following service agreement carefully, as it outlines the terms of your website hosting contract with The Web For Business.com.

The Web For Business.com will host an account for your business, for a period of one year, from the date of your order. The domain name to be hosted is the one which you enter into the form on the order page. The services you will receive with your hosting package are outlined on the page on the Web For Business.com's website that corresponds to your chosen package. The services provided by The Web For Business.com may be terminated by the Account Holder with fourteen (14) days prior written notice to The Web For Business.com.

The Account Holder understands and agrees to the provisions of this Service Agreement.

1. The Virtual Web Server Internet account and/or related electronic services can only be used for legal purposes. Violations of this or any other provision of the Service Agreement may result in a fourteen (14) day notice to terminate service or an immediate notice of termination of service being given by The Web For Business.com to the Account Holder, depending upon the severity of the violation. The Web For Business.com reserves the right to refuse service if The Web For Business.com deems the content of information provided to be potentially illegal, misleading, or obscene, in the opinion of The Web For Business.com. Account Holder agrees not to store, transmit, link to, advertise or make available any images containing nudity or semi-nudity. The Web For Business.com reserves the right to make the final decision in any dispute regarding the acceptability of context, and Account Holder agrees to accept The Web For Business.com's decision.

2. The Web For Business.com reserves the right to change the prices charged for services provided under this Service Agreement, at any time. If the Account Holder prepays for services provided under this Service Agreement on a quarterly, semi-annual, or annual basis, the Account Holder agrees to pay any addition charges due as a result of an increase in price for services during the period of prepayment. The Account Holder's rights and privileges under this Service Agreement cannot be sold or transferred without the prior written consent of The Web For Business.com.

3. The Account Holder agrees to follow generally accepted rules of "netiquette" when sending e-mail messages or posting to newsgroups. Account Holder is responsible for security of its password. The Web For Business.com will not change passwords for any account without proof of identification, which is satisfactory to The Web For Business.com, which may include written authorization with signature. In the event of any partnership break-up, divorce or other legal problem that effects the Account Holder, Account Holder agrees that The Web For Business.com will remain neutral during such dispute and may, at its sole discretion, put the account "on hold" until the dispute has been resolved. Under no circumstances will The Web For Business.com be liable for any losses suffered by Account Holder during this period of dispute, or otherwise.

4. The Account Holder agrees not to harm The Web For Business.com, its reputation, computer systems, programming and/or other Account Holders using The Web For Business.com. The Web For Business.com reserves the right to select the computer for Account Holder's web-site for best performance. If Account Holder breaches this Service Agreement, then The Web For Business.com may terminate service without refund of the unused, prepaid portion of the service, if any. The Account Holder agrees to indemnify and hold harmless both The Web For Business.com and any other Account Holder from and against any and all claims and/or costs resulting from the Account Holder's use or abuse of their service in any manner.

5. Account Holder understands and agrees that this service is provided on a shared server. This means that one web-site can not overwhelm the sever with heavy CPU usage from highly active CGI scripts or chat scripts. If your web-site overwhelms the server and causes complaints from the other users, you have outgrown the realm of shared servers, and will need to relocate your web-site. The Web For Business.com will refund any unused portion of prepaid services. If at any time, Account Holder breaches any part of this contract and The Web For Business.com must engage in the services of an attorney or other legal representation, then Account Holder will pay any and all of The Web For Business.com' reasonable legal fees and court costs.

6. This contract represents the complete understanding between the parties. If Account Holder sells or resells advertising or webspace to a third party then Account Holder will be responsible for the contents of that advertising and the actions of that third party. The Web For Business.com has the right to reject any illegal or offensive content. The e-mail distribution by the Account Holder of "SPAM", "JUNK MAIL", or "UNSOLICITED COMMERCIAL E-MAIL", is expressly prohibited. If Account Holder refuses to remove any content found objectionable by The Web For Business.com, The Web For Business.com may terminate service.

7. The Web For Business.com will use its best efforts to maintain a full time Internet presence for Account Holder. The network may be rendered unserviceable for reasons such as, but not limited to, utility interruption, equipment failure, natural disaster, acts of God, or human error. Account Holder agrees that these events are possible and Account Holder will hold The Web For Business.com, it's employees, owners, contractors, free and harmless from any damages suffered as a result of such unserviceability of the network or for any other reason whatsoever.

8. Under no circumstances will The Web For Business.com's total liability exceed the total amount of fees paid by Account Holder during the term of this Service Agreement. Any amounts paid cannot be refunded by The Web For Business.com in the event Account Holder stops using this service.
